Gardeners Paddington Service Terms and Conditions

These Terms and Conditions govern the provision of gardening and related services by Gardeners Paddington to residential and commercial customers. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person or organisation requesting and receiving the services from Gardeners Paddington.

Services means any gardening, landscaping, garden maintenance, clearance, planting, lawn care, hedge cutting, pruning, or related services provided by Gardeners Paddington.

Agreement means the contract formed between Gardeners Paddington and the Client, consisting of these Terms and Conditions and the specific details confirmed at the time of booking.

Site means the garden, outdoor area or property at which the Services are to be performed.

2. Scope of Services

2.1 Gardeners Paddington provides gardening and related services including but not limited to lawn mowing and lawn care, hedge trimming, pruning and tree care within permitted limits, planting and border maintenance, weed control and garden tidying, garden clearance, green waste handling in line with applicable regulations, soft landscaping and general garden upkeep.

2.2 The exact scope of Services for each visit or project will be agreed with the Client at the time of booking or during an initial consultation. Any description given during the booking process will form part of the Agreement, provided it is confirmed in writing or recorded in the booking notes.

2.3 All Services are subject to the availability of staff, tools, materials and suitable weather conditions. Gardeners Paddington reserves the right to adjust or reschedule Services where adverse conditions or safety concerns make it impractical or unsafe to proceed.

3. Booking Process

3.1 The Client may request a booking by contacting Gardeners Paddington and providing accurate details of the Site, required Services, preferred dates and any access instructions.

3.2 A booking is not confirmed until Gardeners Paddington has accepted the request and provided a confirmation of the appointment date, time window, approximate duration and any specific terms such as minimum charges or call-out fees.

3.3 For larger or more complex projects, Gardeners Paddington may conduct an initial visit or assessment. Quotes provided following such an assessment are based on the information available at that time. If additional work is required or the Site conditions differ significantly from those described, Gardeners Paddington may vary the quote following agreement with the Client.

3.4 The Client must ensure that any necessary permissions, consents or approvals for work at the Site have been obtained prior to the scheduled visit. This includes permissions from landlords, neighbours or local authorities, where relevant.

4. Pricing and Estimates

4.1 Prices may be provided as hourly rates, fixed fees, day rates or project-based quotes, depending on the nature of the Services. Any minimum charges, travel surcharges or disposal fees will be made clear to the Client before confirmation of the booking.

4.2 Estimates are provided in good faith based on typical conditions. If, during the provision of the Services, it becomes clear that significantly more time or materials are required, Gardeners Paddington will notify the Client and seek approval before incurring additional charges.

4.3 Unless stated otherwise, prices are exclusive of any applicable taxes or statutory charges that may apply.

5. Payments and Invoicing

5.1 Payment terms will be agreed with the Client at the time of booking. Gardeners Paddington may require payment on completion of each visit, in advance, or by invoice with a specified payment period.

5.2 Accepted methods of payment will be communicated to the Client and may include bank transfer, card payment, or other cashless methods. Cash payments may be accepted only by prior arrangement and will always be receipted.

5.3 Where Services are invoiced, the standard payment term is due on receipt of the invoice, unless otherwise agreed in writing. The Client is responsible for ensuring that payment is made in full and on time.

5.4 Gardeners Paddington reserves the right to charge interest or late payment fees on overdue amounts in accordance with applicable law. Repeated late payment may result in the suspension or termination of Services.

5.5 For ongoing or regular maintenance services, Gardeners Paddington may operate a recurring billing arrangement. Any changes to fees for regular services will be communicated to the Client with reasonable notice.

6. Cancellations and Rescheduling

6.1 The Client may cancel or reschedule a booking by providing reasonable notice. Gardeners Paddington will inform the Client of the minimum notice period required at the time of booking, typically at least 24 to 48 hours before the scheduled appointment.

6.2 If the Client cancels or reschedules with less than the required notice period, Gardeners Paddington reserves the right to apply a late cancellation fee, which may be up to the full value of the scheduled Service.

6.3 If Gardeners Paddington needs to cancel or reschedule a booking due to staff illness, adverse weather, equipment failure or other circumstances beyond its reasonable control, the Client will be offered an alternative appointment at the earliest mutually convenient time. Gardeners Paddington will not be liable for any indirect loss or inconvenience caused by such changes.

6.4 If, on arrival, Gardeners Paddington is unable to gain access to the Site or perform the Services due to circumstances within the control of the Client, such as locked gates or unsafe conditions, this may be treated as a late cancellation and the relevant fee may apply.

7. Client Obligations and Site Access

7.1 The Client must provide clear and safe access to the Site on the agreed date and time. This includes ensuring that gates are unlocked, any alarm systems are disarmed or instructions provided, and that pets or children are kept safely away from the working area.

7.2 The Client must inform Gardeners Paddington of any hazards at the Site, such as uneven surfaces, hidden cables, ponds, exposed wiring, or any known issues with soil quality, buried services or restricted areas.

7.3 The Client must ensure that water and electricity, where reasonably required for the Services, are available at the Site, unless otherwise agreed.

7.4 Gardeners Paddington may refuse to carry out work that it reasonably considers unsafe, unlawful, likely to cause damage to property or likely to breach local regulations or planning rules.

8. Materials, Plants and Equipment

8.1 Gardeners Paddington will provide its own tools and equipment required to perform the Services, unless otherwise specified. The Client agrees not to use or operate Gardeners Paddington equipment unless expressly permitted by the attending gardener or supervisor.

8.2 Where materials, plants or products are supplied by Gardeners Paddington, they will be of a reasonable quality suitable for their intended purpose. Variations in plant size, colour or exact appearance may occur, and seasonal or supply constraints may limit availability.

8.3 Title to any materials or goods supplied by Gardeners Paddington remains with Gardeners Paddington until full payment has been received. Gardeners Paddington may retrieve unused materials if Services are cancelled or terminated before completion.

9. Garden Waste and Environmental Regulations

9.1 Gardeners Paddington will handle garden waste in accordance with applicable environmental and waste disposal regulations. The standard approach to waste handling, including whether waste is left on site for Client use or removed, will be agreed at the time of booking.

9.2 Where waste removal is included or requested, additional charges may apply based on the volume, type and weight of waste. Gardeners Paddington will not remove hazardous or prohibited materials.

9.3 If the Client chooses to retain green waste on site for composting or other use, the Client is responsible for ensuring that the storage and handling of such waste complies with any relevant regulations or restrictions.

9.4 Gardeners Paddington supports responsible gardening practices and may, where appropriate, recommend sustainable methods of waste reduction, water use and use of environmentally considerate products.

10. Quality of Service and Complaints

10.1 Gardeners Paddington aims to deliver Services with reasonable care and skill. If the Client is dissatisfied with any aspect of the work, they should notify Gardeners Paddington as soon as possible so that issues can be investigated.

10.2 Where a complaint is found to be justified, Gardeners Paddington may, at its sole discretion, re-perform the relevant part of the Services, provide a partial refund, or offer a credit towards future work.

10.3 The Client agrees to allow Gardeners Paddington reasonable access to the Site to inspect and, where appropriate, remedy any issues raised.

11. Liability and Insurance

11.1 Gardeners Paddington will take reasonable care to avoid damage to property while performing the Services. However, minor damage to turf, soil, existing plants or surfaces may occur as an inherent part of gardening work.

11.2 Gardeners Paddington holds appropriate public liability insurance for the Services it provides. Evidence of insurance can be made available to Clients on request.

11.3 To the fullest extent permitted by law, Gardeners Paddington shall not be liable for any indirect or consequential losses, loss of profit, loss of enjoyment, or loss of opportunity arising out of or in connection with the Services.

11.4 Gardeners Paddington shall not be responsible for pre-existing damage, structural defects, unstable trees or plants, or issues resulting from pests, disease, extreme weather, subsidence or other factors beyond its control.

11.5 The overall liability of Gardeners Paddington to the Client for any claim arising out of the Agreement shall, to the extent permitted by law, be limited to the total amount paid or payable by the Client for the specific Services giving rise to the claim.

12. Weather, Seasonal Conditions and Plant Health

12.1 Gardening work is influenced by weather and seasonal conditions. Certain Services may not be suitable or effective at particular times of year, and Gardeners Paddington may advise against specific work where timing could compromise results.

12.2 Plant growth, survival and appearance depend on factors such as soil conditions, watering, exposure, ongoing care and weather. Gardeners Paddington cannot guarantee the performance or longevity of plants once handed over to the Client, and is not liable for plant losses unless directly caused by proven negligence.

13. Termination of Services

13.1 Either party may terminate an ongoing maintenance arrangement by providing reasonable written notice, as agreed at the outset or as later varied by mutual agreement.

13.2 Gardeners Paddington may terminate the Agreement or suspend Services immediately if the Client fails to pay any amount due, behaves abusively towards staff, breaches these Terms and Conditions, or requires work that is unsafe or unlawful.

13.3 On termination, any outstanding balances for Services already performed or materials supplied will become immediately due and payable.

14. Privacy and Data

14.1 Gardeners Paddington will collect and process personal data such as names, addresses and billing details only as necessary to deliver the Services and manage the Client relationship.

14.2 Client information will be stored securely and will not be shared with third parties except where required to perform the Services, process payments, comply with legal obligations or enforce these Terms and Conditions.

15. Changes to Terms and Conditions

15.1 Gardeners Paddington may update these Terms and Conditions from time to time to reflect changes in law, industry practice or its services. The latest version will apply to new bookings made after the date of publication.

15.2 For ongoing arrangements, Gardeners Paddington will notify Clients of any material changes and, where appropriate, seek agreement to the revised terms.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

By proceeding with a booking or permitting Gardeners Paddington to carry out any work at the Site, the Client confirms that they have read, understood and agree to be bound by these Terms and Conditions.
